These Terms of Service (“Terms”) are an agreement between you and BAJAJTECHSOLUTIONZ LLC, a Michigan limited liability company (“DishAdvisor”, “we”, “us”), and govern your use of the DishAdvisor mobile app and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.
You must be at least 13 years old to use the Service. If you are under 18 (or the age of majority where you live), you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms on your behalf.
You can create an account with an email and password, or sign in with Google or Sign in with Apple. You are responsible for activity on your account and for keeping your password and sign-in credentials secure. Tell us promptly at abhasetia.studio@gmail.com if you believe your account has been used without your permission.
You can delete your account at any time from Profile → Delete account. Deletion is permanent and removes your profile, preferences, reviews, photos, favorites, reports and blocks, as described in the Privacy Policy.
Read this section carefully, especially if you have food allergies.
You own what you post. Ratings, reviews, photos, and other content you submit (“Your Content”) remain yours.
License to us. By submitting Your Content, you grant DishAdvisor a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, display, adapt (for example, resizing photos or showing an excerpt), and distribute Your Content in connection with operating, improving, and promoting the Service. This license ends when you delete Your Content or your account, except for copies held in routine backups for a limited time, or where retention is required by law.
Your promises. You confirm that you have the rights to post Your Content, that it reflects your genuine experience, and that it does not violate these Terms or anyone else’s rights.
When you use DishAdvisor, you agree not to:
You can report any review from the dish page and block other users from the same place. We review reports and may remove content or suspend or terminate accounts that violate these Terms, at our discretion and without prior notice. We act on reports of objectionable content within 24 hours. We are not obligated to monitor content, and we are not responsible for content posted by other users.
If you believe content on DishAdvisor infringes your copyright, send a notice to our designated copyright agent at BAJAJTECHSOLUTIONZ LLC, Attn: Copyright Agent, 17738 Stonebrook Dr, Northville, MI 48168, USA, abhasetia.studio@gmail.com containing the information required by 17 U.S.C. § 512(c)(3): your signature, identification of the work and the infringing material, your contact information, a good-faith statement, and a statement under penalty of perjury that your notice is accurate and you are authorized to act. We terminate the accounts of repeat infringers.
The Service — including the app, its software, design, ranking methods, AI-generated summaries, and the DishAdvisor name and logo — is owned by BAJAJTECHSOLUTIONZ LLC and protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your personal, non-commercial use, in accordance with these Terms. All rights not expressly granted are reserved.
If you send us feedback or suggestions, we may use them without any obligation to you.
The Service relies on third-party services, including Google Maps Platform, Yelp, Apple, Google Sign-In, Supabase, and Anthropic. Your use of features powered by Google Maps is also subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy. We are not responsible for third-party services, websites, or restaurants, and your dealings with any restaurant are solely between you and that restaurant.
We may change, suspend, or discontinue any part of the Service at any time. We may update these Terms; when we make material changes we’ll notify you in the app or by email before they take effect. Continuing to use the Service after changes take effect means you accept them.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Sections 3, 4 (to the extent of licenses for content not yet deleted), 7, 8, and 12–15 survive termination.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT DISH, ALLERGEN, OR RESTAURANT INFORMATION IS ACCURATE OR COMPLETE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. Some jurisdictions don’t allow the exclusion of implied warranties, so some of these exclusions may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, DISHADVISOR AND ITS MEMBERS, OFFICERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, ANY CONTENT ON IT, OR ANY MEAL OR RESTAURANT EXPERIENCE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF US $50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. These limits do not apply where prohibited by law.
You agree to indemnify and hold harmless DishAdvisor from claims, damages, and expenses (including reasonable attorneys’ fees) arising from Your Content or your violation of these Terms or of anyone else’s rights.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Wayne County, Michigan, and you and we consent to their jurisdiction. Before filing a claim, you agree to contact us at abhasetia.studio@gmail.com and try to resolve it informally for at least 30 days.
If you downloaded DishAdvisor from the Apple App Store: these Terms are between you and DishAdvisor only, not Apple. Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the app, including product-liability claims, claims that the app fails to meet legal or regulatory requirements, consumer-protection claims, or third-party intellectual-property claims — DishAdvisor is responsible for those. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and are not on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you downloaded DishAdvisor from Google Play: Google’s Play terms also apply to your use of Google Play, and these Terms are between you and DishAdvisor only.
These Terms, with the Privacy Policy, are the entire agreement between you and DishAdvisor about the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
